  The CLIENT agrees to use only email addresses associated with a domain name officially owned by the CLIENT or BENEFICIARY EMPLOYER for its authorized user(s) when registering sub-users or conducting activities on their Bharatrojgar.info account, including sending emails and posting jobs. The use of non-official domains is strictly prohibited. Bharatrojgar.info reserves the right to suspend or terminate services if this condition is violated.
  
  Bharatrojgar.info shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the user's account and / or information relating to or regarding online transactions using credit cards / debit cards and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise.
  
  Payments for the services offered by Bharatrojgar.info (whenever it will be started) shall be on a 100% advance basis. Refund if any will be at the sole discretion of Bharatrojgar.info

  Bharatrojgar.info further reserves its right to post the data on the website Bharatrojgar.info or on such other affiliated sites and publications as Bharatrojgar.info may deem fit and proper at no extra cost to the subscriber / user.

ANY REFERENCE TO DUTIES AND TAXES ETC IN THESE TERMS OF USE SHALL INCLUDE GOODS AND SERVICES TAX (HEREIN REFERRED AS GST) FROM THE DATE GST LAW IS IMPLEMENTED IN INDIA. ANY ADDITIONAL TAX LIABILITY ARISING ON ACCOUNT OF INTRODUCTION OF GST (WHETHER ON ACCOUNT OF INCREASE IN RATE OR ANY CHANGE BROUGHT IN BY THE NEW TAX REGIME) WOULD BE RECOVERED OVER AND ABOVE THE AGREED CONTRACT PRICE / SERVICE FEE.
  
  If any dispute arises between a user/users and BHARATROJGAR.INFO arising out of use of Bharatrojgar.info or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these Terms and Conditions, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by the Company. BHARATROJGAR.INFO offers no guarantee nor warranties that there would be a satisfactory response or any response at all once the resume/ insertion or information/data is fed by the user.
BHARATROJGAR.INFO neither guarantees nor offers any warranty about the credentials bonafied, status or otherwise of the prospective employer/organization which downloads the resume/ insertion or information/data and uses it to contact the user.
BHARATROJGAR.INFO would not be held liable for loss of any data technical or otherwise, or of the resume/ insertion or information/data or particulars supplied by user due to acts of god as well as reasons beyond its control like corruption of data or delay or failure to perform as a result of any cause(s) or conditions that are beyond BHARATROJGAR.INFO 's reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.
It shall be sole prerogative and responsibility of the user to check the authenticity of all or any response received pursuant to the resume/ insertion or information/data being fed into the network system of BHARATROJGAR.INFO by the user, for going out of station or in station for any job or interview. BHARATROJGAR.INFO reserves its right to reject and delete any resume/ insertion or information/data fed in by the user without assigning any reason.
This free service entitles the user alone i.e the same person, to add modify or change the data/information fed in by him but does not entitle him to use the free service to feed fresh insertion or information/data /resume of another person in place of the insertion or information/data already fed in by such user.
BHARATROJGAR.INFO has the right to make all such modifications/editing of resume in order to fit resume in its database.
The subscriber has a sole responsibility of the safe custody of the password shall be that of the subscriber and BHARATROJGAR.INFO shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. BHARATROJGAR.INFO undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber. When you indicate your interest in a Job Listing on Bharatrojgar.info, you are sending your CV and application information including relevant documents to Bharatrojgar.info, and you are requesting and authorizing Bharatrojgar.info to make available such application information to the applicable Employer(s) for such Job Listing(s).

You consent to your application, documents and any responses sent to you by the Employer or vice versa through Bharatrojgar.info being processed and analysed by Bharatrojgar.info according to these terms of use and Bharatrojgar.info's Privacy Policy. Bharatrojgar.info shall store and process such information regardless of whether a job vacancy has been filled. Bharatrojgar.info may use your application materials (including public CVs and responses to employer's questions) to determine whether you may be interested in a Job Listing, and Bharatrojgar.info may reach out to you about such Job Listing.
Information you post in public areas of Bharatrojgar.info sites or applications or make visible in the resume and profile database may be accessed, used, and stored by others around the world, including those in countries that might not have legislation that guarantees adequate protection of personal information as defined by your country of residence. While Bharatrojgar.info takes measures to safeguard your information from unauthorized access or inappropriate use, Bharatrojgar.info does not control these third parties and we are not responsible for their use of information you give to us. Even though you may have marked your profile as unsearchable, on viewing a Bharatrojgar.info Recruiter profile when you are logged into your Bharatrojgar.info account, a snapshot of your profile maybe made visible to the recruiter.

The user represents that he/she is not a minor and is not under any legal or other disability which limits his/her ability to comply with these Terms or to install and use the services subscribed and purchased with minimal risk of harm to you or others. You further represent that you are not purchasing the products/services for resale to others and will not do so without Bharatrojgar.info (India) Limited's prior written consent.
All changes / modifications made by the user to the data / information shall be effected and will come into operation only after 24-48 hours of such changes / modifications being made.

The User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website.

Resume Display (currently all the services are free of cost)
In case necessary inputs required by us for commencing the services are not received by us within 30 days of the payment, the order shall stand cancelled and the any amounts paid shall be appropriated.
The payment for service once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated.
The amount paid entitles the subscriber alone to the service by Bharatrojgar.info for a period of subscription opted for from the date of up-linking of the resume on the website Bharatrojgar.info or such other mirror or parallel site(s) as Bharatrojgar.info may deem fit and proper but such web host shall be without any extra cost to the subscriber / user.
The resume displayed can be updated by the subscriber alone free of cost.
Additionally, through this service your resume is also made a part of Bharatrojgar.info's proprietary database, accessed only by companies/recruiter registered with us. Please log into your account and set the visibility of the resume as desired by you, here you can selectively block a company/recruiter from accessing your resume. This subscription is not transferable i.e. it is for the same person throughout the period of subscription.

The liability, if any, of Bharatrojgar.info is limited to the extent of the amount paid by the subscriber.
The subscriber has the sole responsibility of the safe custody of the password shall be that of the subscriber and Bharatrojgar.info shall not be responsible for data loss/theft or data/corruption or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. You understand and agree that such mechanisms are intended to safeguard your interests, prevent exploitation or fraud, and maintain the integrity of the recruitment process facilitated through the Platform. You will comply with all applicable data protection laws in relation to the processing of personal data; and not process personal data in an unlawful manner and excessive with regard to agreed purposes as defined in the privacy policy and this terms and conditions
You shall implement adequate technical and organizational controls to protect the shared personal data obtained from the Company against unauthorised or unlawful processing and against accidental loss, destruction, damage, alteration or disclosure
The onus of any misuse of personal details accessed through your account lies on You. Access to services subscribed by You may be availed of and extended to authorized personnel only i.e. persons who are bound by employment agreements and confidentiality agreements
You agree to provide reasonable assistance as is necessary to facilitate the handling of any Data Security Breach (as relevant under privacy laws applicable) in an expeditious and compliant manner

The Bharatrojgar.info Recruiter profile may be updated/edited etc. by the user alone. The user shall not upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libellous, vulgar, obscene, or racially, ethnically, or otherwise objectionable.
Uploading of multiple profiles by the same recruiter using the same or different accounts shall entitle Bharatrojgar.info to remove the profiles without notice to the subscriber.
BHARATROJGAR.INFO reserves its right to reject and delete any profile or information/data fed in by the user without assigning any reason.
The sole responsibility of the safe custody of the log in details shall be that of the user and BHARATROJGAR.INFO shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. BHARATROJGAR.INFO undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password created by the user/recruiter.
BHARATROJGAR.INFO shall in no way be held liable for any information received by the user and it shall be the sole responsibility of the user to check, authenticate and verify the information/response received at its own cost and expense.
The user represents that he/she is not a minor and is not under any legal or other disability which limits his/her ability to comply with these Terms or to install and use the services subscribed and purchased with minimal risk of harm to you or others.
All changes / modifications made by the user to the data / information shall be effected and will come into operation only after 24-48 hours of such changes / modifications being made.
On registration you agree:
1. to make your profile available for display in the public domain.

  Accordingly, Bharatrojgar.info may, without prior notice:
Present contact information such as phone numbers or email addresses in a manner that enhances user privacy and mitigates risks of misuse or unauthorized access.
Withhold, block, or decline to transmit any communication that it reasonably believes to be malicious, harmful, violate of these Terms, or inconsistent with applicable law.
Use automated tools or filters to detect and flag messages that may be harmful or violate the law, within the limits allowed by law.

A User accessing the Bharatrojgar.info Platform shall be bound by these Terms of Service, and all other rules, regulations and terms of use referred to herein or provided by Bharatrojgar.info in relation to any services provided via the Bharatrojgar.info Platform / our services

Bharatrojgar.info shall be entitled to modify these Terms of Service, rules, regulations and terms of use referred to herein or provided by Bharatrojgar.info in relation to any Bharatrojgar.info Services, at any time, by posting the same on the Bharatrojgar.info Platform. Deactivate or delete a User's account and all related information and files on the account;

Assign its rights and liabilities to all User accounts hereunder to any entity (post such assignment intimation of such assignment shall be sent to all Users to their registered email ids)

In the event any User breaches, or Bharatrojgar.info reasonably believes that such User has breached these Terms of Service, or has illegally or improperly used the Bharatrojgar.info Platform or Bharatrojgar.info Services, Bharatrojgar.info may, at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User's access to all or any part of the Bharatrojgar.info Platform, deactivate or delete the User's account and all related information on the account, delete any content posted by the User on Bharatrojgar.info and further, take technical and legal steps as it deems necessary

If Bharatrojgar.info charges its Users a platform fee in advance in respect of any Bharatrojgar.info Services, Bharatrojgar.info shall, without delay, repay such platform fee in the event of suspension or removal of the User's account or Bharatrojgar.info Services on account of any negligence or deficiency on the part of Bharatrojgar.info, but not if such suspension or removal is effected due to:

any breach or inadequate performance by the User of any of these Terms of Service; or

any circumstances beyond the reasonable control of Bharatrojgar.info

By accepting these Terms of Service Users are providing their consent to receiving communications such as announcements, administrative messages and advertisements from Bharatrojgar.info or any of its partners, licensors or associates

Participation

When accessing and interacting with the Bharatrojgar.info Platform and Bharatrojgar.info Services a User will be able to view and apply for jobs posted by potential employers for their respective organizations

To view and apply for a job a User shall be required to provide information about the User's education, qualifications, past experience and skills. While Bharatrojgar.info does not tolerate or allow for discrimination on the basis of gender, certain jobs might be gender specific and might be available only to persons of a certain gender. The User understands and acknowledges that such stipulations as to gender specifications for a certain job are not mandated by Bharatrojgar.info and that such stipulation is made by the job poster

By agreeing to these Terms of Service and while applying for a job through the Bharatrojgar.info Platform, Users undertake that all information shared will at all times be accurate and not be misleading. The User understands and acknowledges that any incorrect information or misrepresentations made by the User will affect the efficacy of the Bharatrojgar.info Platform and Bharatrojgar.info Services and that Bharatrojgar.info shall have the right to suspend the User's account if it is found that the information shared by the User is false or misleading

The job applications by the Users on the Bharatrojgar.info Platform shall remain active only for a period of 60 (sixty) days from the date of application to the job posts and upon the expiry of the said period of 60 (sixty) days, such job applications shall be archived. The potential employers shall not have access to the list of such Users or to the Archived Job Applications upon the expiry of 60 (sixty) days. The Users, however, may re-apply to a job post (if still active) after the expiry of 60 (sixty) days from the date such User made their first application to the same job post

Users agree that they shall at all times be bound by and adhere to the Code of Conduct while accessing the Bharatrojgar.info Platform and while using the Bharatrojgar.info Services

Intellectual Property

The intellectual property rights** in all software underlying the Bharatrojgar.info Platform and the Bharatrojgar.info Services and material published on the Bharatrojgar.info Platform, including (but not limited to) software, advertisements, content (whether written, audio and/or visual), photographs, graphics, images, illustrations, graphs, charts, marks, logos, audio or video clippings, animations etc. is owned by Bharatrojgar.info, its affiliates, partners, licensors and/or associates. A User's correspondence, transactions and usage of the services/offers of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third party.

The User agrees that Bharatrojgar.info will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third-party product or service should be directed to the appropriate vendor.

Privacy Policy

All information collected from Users, such as registration (including but not limited to email addresses, mobile phone numbers, and government identity documentation) and payment information, is subject to Bharatrojgar.info's Privacy Policy.

We do not share personal information of any individual with other companies/entities without obtaining permission. We may share all such information that we have in our possession in accordance with our Privacy Policy

Once the personal information has been shared with you, you shall, at all times, be responsible to secure such information.

User Conduct

Deactivating or deleting a User's account and all related information and files on the account. Any amount remaining unused in the User's account on the date of deactivation or deletion shall be transferred to the User's bank account on record with Bharatrojgar.info subject to a processing fee (if any) applicable on such transfers as set out herein.

Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by Bharatrojgar.info). Users further agree to update and keep updated their registration information and other information as may be required by Bharatrojgar.info

A User shall not register or operate more than one User account with Bharatrojgar.info

Users agree to ensure that they can receive all communication from Bharatrojgar.info either by email, SMS, WhatsApp or any other mode of communication from Bharatrojgar.info. Bharatrojgar.info shall not be held liable if any communication sent to the User by Bharatrojgar.info remains unread by the User.

Any password issued by Bharatrojgar.info to a User may not be revealed to anyone else. Users may not use anyone else's password. Users are responsible for maintaining the confidentiality of their accounts and passwords. Users agree to immediately notify Bharatrojgar.info of any unauthorized use of their passwords or accounts or any other breach of security.

Users agree to exit/log-out of their accounts at the end of each session. Bharatrojgar.info shall not be responsible for any loss or damage that may result if the User fails to comply with these requirements.

Users agree not to use cheats, exploits, automation, software, bots, hacks or any unauthorized third-party software designed to modify or interfere with the Bharatrojgar.info Services and/or Bharatrojgar.info experience or assist in such activity.

Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying the Bharatrojgar.info Platform or Bharatrojgar.info's Services.

Users agree that without Bharatrojgar.info's express written consent, they shall not modify or cause to be modified any files or software that are part of Bharatrojgar.info's Services or the Bharatrojgar.info Platform.

Users agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support the Bharatrojgar.info Platform or Bharatrojgar.info's Services (each a Server); or (2) the enjoyment of Bharatrojgar.info Services by any other User or person.

A User shall not publish any content that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.

To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication;

To harass, stalk, threaten, or otherwise violate any legal rights of other individuals;

To interfere with or disrupt the Bharatrojgar.info and/or the Bharatrojgar.info Platform, Bharatrojgar.info servers, or Bharatrojgar.info networks;

To impersonate any person or entity, including, but not limited to, a representative of Bharatrojgar.info, or falsely state or otherwise misrepresent User's affiliation with a person or entity;

To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through Bharatrojgar.info or to manipulate User's presence on the Bharatrojgar.info Platform;

To take any action that imposes an unreasonably or disproportionately large load on Bharatrojgar.info's infrastructure;

To engage in any illegal activities;

To engage in any action that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation

If a User chooses a username that, in Bharatrojgar.info's considered opinion is obscene, indecent, abusive or that might subject Bharatrojgar.info to public disparagement or scorn, or a name which is an official team/league/franchise names and/or name of any sporting personality, as the case may be, Bharatrojgar.info reserves the right, without prior notice to the User, to restrict usage of such names, which in Bharatrojgar.info's opinion fall within any of the said categories and/or change such username and intimate the User or delete such username and posts from Bharatrojgar.info, deny such User access to Bharatrojgar.info, or any combination of these options

Dispute and Dispute Resolution

If any dispute arising out of, or in connection with, the Bharatrojgar.info Services provided by Bharatrojgar.info via the Bharatrojgar.info Platform, the construction, validity, interpretation and enforceability of these Terms of Service, or the rights and obligations of the User(s) or Bharatrojgar.info, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below arises between the User(s) and Bharatrojgar.info (Dispute), the disputing parties hereto shall endeavour to settle such Dispute amicably. The attempt to bring about an amicable settlement shall be considered to have failed if not resolved within 30 (thirty) days from the date of communicating the Dispute in writing.

If the parties are unable to amicably settle the Dispute as mentioned above, any party to the Dispute shall be entitled to serve a notice invoking Arbitration. The Dispute shall be referred to and finally resolved by arbitration. The Arbitration shall be conducted by an Arbitral Tribunal consisting of a sole arbitrator in accordance with the Rules of the Gujarat International Arbitration Centre**,** which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Ahmedabad Gujarat. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English. The law governing the arbitration agreement shall be Indian Law.

Nothing shall preclude any Party from seeking interim or permanent equitable or injunctive relief, or both, from the competent courts at Ahmedabad Gujarat, having jurisdiction to grant relief on any Disputes. The pursuit of equitable or injunctive relief shall not be a waiver of the duty of the Parties to pursue any remedy (including for monetary damages) through the arbitration described herein.

The arbitration award will be final and binding on the Parties.

Release and Limitations of Liability

Users shall access the Bharatrojgar.info Services provided via the Bharatrojgar.info Platform voluntarily and at their own risk. Bharatrojgar.info shall, under no circumstances be held responsible or liable on account of any loss or damage sustained by Users or any other person or entity during the course of access to the Bharatrojgar.info Platform.

By accessing the Bharatrojgar.info Platform and Bharatrojgar.info Services provided therein, Users hereby release from and agree to indemnify Bharatrojgar.info, and/or any of its directors, employees, partners, associates and licensors, from and against all liability, cost, loss or expense arising out their access of the Bharatrojgar.info Platform and the Bharatrojgar.info Services including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.

In consideration of Bharatrojgar.info allowing Users to access the Bharatrojgar.info Platform, to the maximum extent permitted by law, the Users waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Bharatrojgar.info, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the provision of Bharatrojgar.info Services.

Disclaimers

To the extent permitted under law, neither Bharatrojgar.info nor its parent/holding company, subsidiaries, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the mis-delivery, or the untimely delivery of any information or material.

In case Bharatrojgar.info discovers any error, Bharatrojgar.info reserves the right (exercisable at its discretion) to rectify the error in such manner as it deems fit, including through a set-off of the erroneous payment from amounts due to the User or deduction from the User's account of the amount of erroneous payment.

In case of exercise of remedies in accordance with this clause, Bharatrojgar.info agrees to notify the User of the error and of the exercise of the remedy(ies) to rectify the same.

To the extent permitted under law, neither Bharatrojgar.info nor its partners, licensors or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use our sites, even if Bharatrojgar.info has been advised of the possibility of such damages.

In the complaint or grievance, the User shall include the following information:

Relation to the subject matter of the complaint, i.e. complainant or person acting on behalf of an affected person;

The name and age of the person aggrieved or affected by the subject matter of the complaint, in case the User is acting on behalf of such person and a statement that the User is authorised to act on behalf of such person and to provide such person's personal information to Bharatrojgar.info in relation to the complaint/grievance;

Description of the complaint or grievance with clear identification of the Content in relation to which such complaint or grievance is made;

A statement that the User believes, in good faith, that the Content violates these Terms and Conditions;

A statement that the information provided in the complaint or grievance is accurate.

All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Bharatrojgar.info Platform belonging to any person (including User), entity or third party are recognized as proprietary to the respective owners. Users are requested to send Bharatrojgar.info a written notice/ intimation if Users notice any act of infringement on the Bharatrojgar.info Platform, which must include the following information:
